Civil law and contracts

Civil law is the field that regulates the relationships between private parties and between businesses. The office covers both the contractual stage, to prevent disputes, and the litigation stage.

Contracts

Drafting and review of commercial contracts, general terms and conditions, distribution, agency and supply agreements.

Sector-specific contracts, with particular focus on public and private works (procurement law).

Shareholders' agreements, non-disclosure agreements (NDAs), licence agreements.

Road accidents and damages

Assistance to people involved in road accidents: handling claims with insurance companies and, where needed, judicial action.

Quantification of biological, economic, moral and existential damages, with the support of trusted medical-legal experts.

Protection of pedestrians, cyclists, motorcyclists and passengers; fatal and serious-injury accidents.

Traffic fines and Highway Code matters

Appeals to the Justice of the Peace and to the Prefect against traffic fines and administrative sanctions.

Driving licence suspension and revocation, point deductions, administrative impoundment of vehicles.

Driving under the influence of alcohol or narcotics, vehicular homicide and vehicular injury.

Debt recovery

Out-of-court debt recovery: demand letters, negotiations and repayment agreements.

Judicial recovery: payment orders, writs of execution, enforcement on assets, real estate and third parties.

Opposition to payment orders and enforcement proceedings.

Civil litigation

Cases involving contractual and tortious liability, including medical malpractice.

Corporate and banking law: anatocism and usury claims, disputes between shareholders.

Mediation and assisted negotiation

Where possible, alternative dispute resolution is preferred: civil mediation and assisted negotiation avoid litigation, reduce time and cost, and preserve the relationship between the parties.
